Rule 3: Time
(a)
In computing any period of time set forth herein, the day from which the
period is to commence shall not be counted and the last day of the period shall
be counted; provided, however, that any time period under seven (7) days will
not include intermediate Saturdays, Sundays, or legal holidays in the period and
any period which would otherwise end on a Saturday, Sunday, or legal holiday
will extend to end of the next day which is not a Saturday, Sunday or legal
holiday.
(b)
The Court for good cause shown may enlarge the prescribed period of time
within which any required act may be done.
(c)
Whenever service is accomplished by mail, three days shall be added to
the prescribed period of time, but such addition shall not cause Saturdays,
Sundays, or legal holidays to be counted in the time period if they would not
otherwise have been counted.
Note of Amendment: What was formerly Rule 3(c) regarding timing and service of motions was deleted in November 1994. Timing of motions was moved to Rule 5. Motions Practice.
