Rule 46: Enforcement of Foreign Child Support Orders
(a)
All the terms of a foreign child support order which this Court has
ordered be given full faith and credit, and which this Court has ordered be
enforced pursuant to Rule 39, shall be included in this Court's order or
judgment requiring enforcement of the foreign order including
statutorily-mandated adjustments such as cost-of-living adjustments and
adjustments for arrearages. Collection
of such additional amounts from Prairie Island Indian Community members or
employees shall occur as it would in the jurisdiction of the foreign child
support order, and no further order of this Court shall be necessary to collect
such amounts.
(b)
If a foreign child support order which this Court has ordered be given
full faith and credit, and which this Court has ordered be enforced pursuant to
Rule 39, is modified as a result of further proceedings in the foreign court,
the modified order must be presented to this Court for a determination as to
whether it is entitled to full faith and credit and, in the event the Court
determines that full faith and credit should be given, whether the order should
be enforced, just as the original order was.
Note of Amendment: Rule 46 was added to the Code in March, 1997.
