Trespass Notice Procedures


The following procedures are used by designated Casino personnel to serve persons legal notice of trespass. The Casino personnel’s authority to trespass individuals from Treasure Island Resort & Casino and its associated facilities is granted by tribal resolution naming the personnel and/or positions. (SEE ATTACHMENT 1) Trespass Notice forms and records are maintained by the Security Department.

PURPOSE

A legal notice of trespass is a serious action taken to prohibit entry into the facility or onto the grounds controlled by Treasure Island Casino. This action is taken to protect guests, employees, and/or the assets of Treasure Island Casino.

DECISION TO TRESPASS

The designated individual must review the actions to determine the appropriate course of action. The facts of the situation must demonstrate that the individual’s continued presence would not be in the best interest of the Casino. For minor infractions, a simple request for the individual to leave for the day may be appropriate. Refusal to leave and/or other infractions may result in serving a formal notice of trespass. The on-duty Security Supervisor should be notified immediately whenever a situation may result or has resulted in the decision to trespass. The Security Supervisor is responsible for insuring the proper notification and documentation is completed. The Security Supervisor will also contact the local police for assistance when necessary.

POSITIVE IDENTIFICATION

Positive identification is essential to trespass actions. When an individual refuses to provide identification, the Red Wing Police Department may be contacted and assistance requested. If the police can not assist, identification will be documented in the best way possible through other information, witnesses, employee IDs, etc. The individual will be photographed whenever possible. A refusal to be photographed is simply documented in reports. The Surveillance Department’s assistance is also requested to document identification using their equipment.

SECURITY SUPERVISOR’S RESPONSIBILITIES

Complete the top portion of the form with identifying information.

Explain to the individual that the Trespass Notice is a legal notification that he/she may no longer enter Treasure Island Casino’s buildings and/or grounds. (Such entrance prior to the expiration date of the notice may result in notification of Law Enforcement Officials with charges filed for trespass.)

Determine and state the length of time the individual is banned from the property in the blank "This trespass will be in effect until " using the guidelines on ATTACHMENT 2. The designed personnel may request a different length of time or period of trespass by appeal to the Director of Security.

Have the individual (Trespassee) date and sign the Trespass Notice.

Remind the individual that:

any violation of the trespass will have an additional period added to the originally designated term.

those with indefinite trespass can be detained and the Red Wing Police Department summoned.

Security supervisory personnel along with a witness will print and sign their name under the area marked "Notice Served By " .

Leave the Summary area blank.

Give the pink copy to the individual. (This copy may also be mailed to the individual.)

Escort the individual from Treasure Island Casino property.

The yellow and original Trespass Notice will be retained in Dispatch with photos attached.

Take a photo-copy of the Trespass Notice to be retained in Dispatch with photos attached.

In the Summary area of the copy, write a short narrative of why the individual was trespassed. (See number 3 above.)

Insert the copy and photo(s) into the "Trespass Notice Notebook" retained in Dispatch.

 

REVIEW OF TRESPASS

The Director of Security will review all formal Trespass Notices and associated reports for approval. The Director will also maintain records and current status of all Trespass Notices.

APPEAL OF TRESPASS

An individual wishing to appeal trespass action may do so by contacting the Director of Security, General Manager, or Tribal Council. The Director of Security may change the length of trespass, or remove the trespass if a review warrants such action. If recommendation is to maintain the trespass status, The Director of Security will forward documentation to the Legal Department for review and the Tribal Council for determination.

DELEGATION OF AUTHORITY TO TRESPASS

Treasure Island Casino employees performing their assigned duties in the positions listed below are delegated authority to trespass individuals from Treasure Island Casino property. This property includes the buildings, parking lots, RV Park, Marina and facilities under operational control of the Casino General Manager.

GUIDELINES FOR LENGTH OF TRESPASS

Listed below are the normally recommended length of time an individual would be trespassed for the listed situations. The authorized individual invoking the trespass may deviate on the length of trespass period whenever the situation warrants. For situations not listed, the period should be similar to the situations listed below based on the severity or until further notice.

 

LEAVE FOR THE DAY – NO FORMAL WRITTEN NOTICE

NOTE: IF AN INDIVIDUAL IS UNCOOPRATIVE, PROCEED WITH MINIMUM THIRTY(30) DAY TRESPASS AND FORMAL WRITTEN NOTICE.

Unruly Guest

Loitering

Intoxication

Minor Disruptions

THIRTY(30) DAY SUSPENSION

Loitering: FIRST OFFENSE

Violation of Coupon Promotions: (Excessive number of coupons) FIRST OFFENSE

Abusing Tracking System: (placing card in another guest’s machine – multi-card use) FIRST OFFENSE

Careless Driving: (driving in a manner likely to cause an accident.)

SIXTY(60) DAY SUSPENSION PERIOD

Panhandling: FIRST OFFENSE

Violation of Coupon Promotions: SECOND OFFENSE

Guest/Employee Harassment/Verbal Abuse: FIRST OFFENSE

Fraudulent/Altered ID

Loitering: SECOND OFFENSE

Abusing Tracking System: SECOND OFFENSE

Guest/Employee Harassment: SECOND OFFENSE

UNTIL FURTHER NOTICE

Violation of Special Restrictions (EX: No Table Games)

Theft

Swindling

Assaults (physical)

Capping Bets

Undesirable Gaming Activities
